Formal Complaints

 

Upon the completion of an investigation into a complaint or employer’s notice, the Professional Conduct Committee (PCC), may charge a registered teacher with having committed professional misconduct or professional incompetence. The PCC does this by lodging a formal complaint with the Discipline Committee. Formal complaints; the date, time and location of hearings; and decisions of the Discipline Committee are made public on the SPTRB’s website.


Hearing Dates

Disciplinary hearings of the Saskatchewan Professional Teachers Regulatory Board are open to the public. Notices of hearings are to advise members of the public about the time and place the hearing will occur.  

These matters have been referred to the Discipline Committee for a public hearing after the Professional Conduct Committee conducted a full investigation. Details of individual hearings can be found below.

Decisions of the Discipline Committee

The Registered Teachers Act grants the SPTRB the authority to set and monitor the standards of conduct and competence for registered teachers in Saskatchewan. The purpose of publishing discipline outcomes is to enhance the transparency of discipline processes, educate registered teachers and the public about the standards, and provide the public with confidence that registered teachers who do not meet the standards will be held accountable. 

Decisions of the Discipline Committee are made public on the SPTRB website. Decisions are posted once the 30-day period for bringing an appeal has expired and no appeal has been brought.

Consensual Complaint Resolution Agreements

The Professional Conduct Committee (PCC) may deem a complaint appropriate for a consensual complaint resolution agreement (CCRA). A CCRA is a process by which a teacher admits to having committed misconduct or incompetence and consents to taking measures to rectify the situation that led to the complaint. Complaints referred for consensual complaint resolution must be resolved to the satisfaction of the complainant, the teacher who is the subject of the complaint and the PCC. All CCRA’s are made public on the SPTRB’s website.

* Regulatory Bylaw 1.10(1) In instances when the agreed remedy in a consensual complaint resolution agreement does not include the suspension or cancellation of a teacher’s teaching certificate, the Registrar shall, upon the expiration of a two-year period from the date that the terms and conditions of the agreement were satisfied, redact all personal information from the publicized consent resolution agreement.
 

** Regulatory Bylaw 1.10(2) In instances when the agreed remedy in a consensual complaint resolution agreement includes the suspension of a teacher’s teaching certificate and five years have passed since the terms and conditions of the agreement were satisfied, the Certificate Reinstatement Review Committee, upon the basis of a request and written submissions from the teacher who is the subject and signatory of the consensual complaint resolution agreement, shall decide on the request for redaction of personal information from a consent resolution agreement.

Other Agreements

In some situations, the SPTRB will determine it necessary to enter into agreements with individuals related to disciplinary matters. These agreements are in addition to (and not in lieu of) the standard disciplinary process and are typically protective in nature.

 

Cessation Agreements

Rather than seek a temporary suspension of a teacher’s certificate from the courts, a more efficient means of achieving the same result is for the teacher to formally agree to cease certain activities. Some circumstances require making the agreement and its contents available to the public to inform the public and to protect the public interest.
